Anyone on any database or mailing list that you provide us must have "opted in" to receive electronic mail from your organisation. You must be able to tell the contacts on your list how you received their details.

When we manage invitations to surveys, we do so on your behalf and any email must include an "unsubscribe" link that allows subscribers to remove themselves from the email messages. We acknowledge and agree that we will not hide, disable, or remove or attempt to hide, disable, or remove the opt-out link from the email invitation. We will actively manage and process unsubscribe requests received by us directly within ten days of submission, and update email lists and address books to reflect the unsubscribe requests.

If you, as a client of ours, manage the email database the above remains your responsibility.

Our surveys are hosted on servers located in the United States and Australia. Response data that is provided by respondents therefore may be stored on these servers in either of those countries.

Permission Lists Only

We have a zero-tolerance spam policy. All recipients sent to must have opted in to receiving communications from your organisation, the sender (even if we send emails on your behalf at your request). If you don't have proof that each recipient on your list opted in for your emails, don't include them on any list you supply us or you email to.

• We will not use third-party, purchased, rented, or harvested mailing lists.
• We cannot mail to newsgroups, message boards, distribution lists, or unsolicited email addresses.
• You and we agree that you shall not utilize the Survey Tool to send any commercial electronic mail messages (as defined in the Act of 2003) to any recipient who has opted out, unsubscribed, or otherwise objected to receiving such messages from you or another party on whose behalf you may be commissioned. The CAN-SPAM Act outlines requirements for sending out commercial emails. These rules govern the Internet by United States law. A brief description of the CAN-SPAM Act follows:
1. Bans false or misleading header information. Requires valid "reply" and "from" addresses. These must be accurate and identify the person who initiated the email. If we send an email on your behalf we will identify the email as such.
2. Prohibits deceptive subject lines. The subject line cannot mislead the recipient about the contents or subject matter of the message.
3. Requires the email to provide recipients with a valid opt-out method. You must provide a return email address or another Internet-based response mechanism that allows a recipient to ask you not to send future email messages to that email address, and you must honor the requests. You may create a "menu" of choices to allow a recipient to opt out of certain types of messages, but you must include the option to end any commercial messages from the sender. Any opt-out mechanism you offer must be able to process opt-out requests for at least thirty days after you send your commercial email. When you receive an opt-out request, the law gives you ten business days to stop sending email to the requestor's email address. You cannot help another entity send email to that address, or have another entity send email on your behalf to that address. Finally, it's illegal for you to sell or transfer the email addresses of people who choose not to receive your email, even in the form of a mailing list, unless you transfer the addresses so another entity can comply with the law.
4. Include physical mailing address. You message must contain clear and conspicuous notice that the message is an advertisement or solicitation and that the recipient can opt out of receiving more commercial email from you. It also must include your valid physical postal address. (When we send an email invitation on your behalf we will include your organisation details).

By using this website and/or our services we agree to maintain confidentiality to the extent allowed under law. This includes any survey results, database respondent details, employee details etc.

Any list or database that you provide to us remains your property and we will not on-sell, aggregate or make public any details. We will only ever contact those people on your behalf (ie invite to take part in one of your surveys), and only upon your direct instruction.

If we use a third-party recruiting company to gain respondents upon your commissioning, those user details remain the property of the recruiting company.

If we manage a database on your behalf (where people have joined as per your instruction), it remains your property and is effectively your database. Any requests for unsubscription that are received directly by you are required to be forwarded to us immediately so we can process. We take no responsibility for negligence of this on you part and retain the right to cease sending emails on your behalf if we believe you are providing us with non opted-in respondents.

If you no longer use our services we will return the most recent copy of the database or mailing list to you within 21 days of notification. The database remains your property at all times and our role is only to manage it and email invitations to take surveys on your behalf.
